Section 104
An institution or association can be declared as problematic
: (1) If it is found that the following conditions exist in any institution or association from the inspection or account check conducted in accordance with this Act, the Registrar shall recommend to the Ministry to declare such institution or association as a problematic organization or association:-
(a) has done any act contrary to the interest of the member,
(b) The institution or association has not fulfilled the financial obligations to be fulfilled or is unable to pay the obligations to be paid or is unable to pay,
(c) Not being able to return the savings of the members as per the prescribed conditions,
(d) An organization or association operating in contravention of this Act, the rules and regulations made under this Act,
(e) the organization or association is in a position to fall into bankruptcy or is experiencing significant financial difficulties,
(f) If an organization or association has not returned the member's savings within the period in which at least twenty-five members of such organization or association have submitted an application to the registrar, it is found that any of the conditions under clauses (a) to (e) exist,
(2) If the recommendation under sub-section (1) is received, the Ministry may declare such organization or association as a problem organization or association.
(3) Notwithstanding anything written elsewhere in this section, if the commission established by the Government of Nepal in accordance with the prevailing law recommends that any organization or association be declared a problematic organization or association, or if it is identified as problematic or based on the number of complaints received by such commission, including justification, the ministry may The union may be declared a problematic organization or association.
